Abstract:
The article comments the jurisdictional control of public policies within the Brazilian
basic education, delimiting the topic by the constitutional parameters, by the National
Educational Bases and Guidelines Law (LDB) and other legal devices tied to the
subject. From this theme, the following question arises: To what extent the Judiciary
can exercise the jurisdictional control of public policies in Basic Education? Analyzing
by means of bibliographical research and collating multiple authors, one can obtain
certainty that the ultimate goal of public policy focused on Basic Education is to
guarantee the access and effectuation of fundamental rights so that the population
can exercise its citizenship worthily through the exchange between the powers when
there is omission by the State.
