EDUCAÇÃO COMO DIREITO SOCIAL: OS IMPACTOS DO TRABALHO INFANTIL NO USO DESSE DIREITO

Abstract:

In a society ruled by one of the most beautiful and complete Federal Constitutions in the world, in which rights were acquired as well as duties aimed at respecting the holistic needs of the human being, we are faced with a special, the right to education. But for many, this right is just an option. Starting from the questions: What are the impacts on the school life of working children and adolescents? "And" What are the difficulties faced by the school and the Guardianship Council to eradicate child labor in the Jacaraípe neighborhood in the municipality of Serra, Espírito Santo? I have as objectives to identify and reflect on the current impacts on the school life of children and adolescents who carry out work activities and to know the challenges faced by 29 the school and the Guardianship Council to eradicate child labor in Brazil; observe the performance of school institutions in relation to child labor; understand the ways of oversight of public agencies as a Guardianship Council, and identify the actions and projects that attempt to eradicate the problem studied. The main theoretical references used are the productions of the ILO - International Labor Organization, the Ministry of Labor and Employment, and the judges, lawyers and promoters involved in this subject, in addition to the Federal Constitution 1988 and the Statute of the Child and Adolescent (Law no. No. 8,069 / 90). This research is qualitative and semi-structured interviews were conducted with structured questionnaires, with children doing child labor, education professionals and tutorial counselors, which made it possible to understand the difficulty in relation to the eradication of this social problem, linking it with a discourse socially and historically produced present in today's society. Among the results I highlight the knowledge of the problem by society and the lack of effectiveness of public programs aimed at the eradication of child labor, as well as the lack of knowledge of society regarding the National Program for the Eradication of Child Labor.

Em uma sociedade regida por uma das mais belas e completas Constituições Federais do mundo, em que direitos foram adquiridos bem como deveres visando respeitar as necessidades holísticas do ser humano, nos deparamos com um em especial, o direito à educação. Porém, para muitos, esse direito é apenas uma opção. Partindo das perguntas: Quais os impactos presentes na vida escolar de crianças e adolescentes que exercem atividades laborais?” e “Quais as dificuldades enfrentadas pela escola e pelo Conselho Tutelar para erradicar o trabalho infantil no bairro Jacaraípe, no município da Serra, no Espírito Santo? Tenho como objetivos identificar e refletir sobre os impactos presentes na vida escolar de crianças e adolescentes que exercem atividades laborais e conhecer os desafios enfrentados pela escola e pelo Conselho Tutelar para erradicar o trabalho infantil no Brasil; observar a atuação das instituições escolares em relação ao trabalho infantil; entender os caminhos da fiscalização dos órgãos públicos como Conselho Tutelar, e identificar as ações e os projetos que tentam erradicar o problema estudado. As principais referências teóricas utilizadas são as produções da OIT - Organização Internacional do Trabalho, do Ministério do Trabalho e Emprego e dos juízes, advogados e promotores envolvidos nesta temática, além da Constituição Federal 1988 e o Estatuto da Criança e do Adolescente (Lei n.º 8.069/90). Esta pesquisa é qualitativa e foram realizadas entrevistas semiestruturadas com questionários estruturados, com crianças exercendo labor infantil, profissionais da educação e conselheiras tutelares, que possibilitaram entender a dificuldade em relação a erradicação deste problema social, vinculando-a com um discurso socialmente e historicamente produzido presente na sociedade atual. Dentre os resultados, destaco o conhecimento do problema pela sociedade e a falta de eficácia dos programas públicos voltados para a erradicação do trabalho infantil.
