dc.description.abstract	The present paper aims to answer the following question: In the case of violence against women is it possible to issue pre-trial detention during the Police Inquiry? The article brings an existing conflict between the Code of Criminal Procedure and Special Law 11.340 / 06, where the General Law means that it will only be possible to issue pre-trial detention during the procedural phase, and the Special Law ensures that it will be the arrest Preventive during any phase. By using legislation and jurisprudence on the subject, there is the existing conflict and the misuse of Special Law 11.340 / 06, which, if used as it should, would prevent the number of violence and murder of women from growing as it has grown absurdly in last years.	pt_BR
dc.description.sponsorship	O presente trabalho visa responder ao seguinte questionamento: No caso de violência contra a mulher é possível a decretação de prisão preventiva de ofício durante o Inquérito Policial? O artigo traz um conflito existente entre o Código de Processo Penal e a Lei Especial 11.340/06, onde a Lei Geral traz que só será possível a decretação da prisão preventiva de ofício durante a fase processual, já a Lei Especial assegura que caberá a prisão preventiva de ofício durante qualquer fase. Utilizando-se legislações, jurisprudências e casos concretos sobre o tema verifica-se o conflito existente, e o mau uso da Lei Especial 11.340/06, que se fosse utilizada como deveria, evitaria que o número de violência e assassinato de mulheres crescesse como vem crescendo absurdamente nos últimos anos.	pt_BR
