dc.description.abstract	The present work evidenced accounts of pollution caused by mining companies and industries that emit the so-called black powder in the region of Greater Vitória and aims to answer the following question: Which judicial mechanisms can the individual citizen be used to make responsible for the emission of black powder in the Great victory? The article will clarify the measures that can be taken by the public power, to address about Social Rights. It will show the importance of the term of conduct adjustment in the environmental area, as well as dealing with Public Civil Action, protection of the environment and PopularAction, in health protection, laser to public patrimony. Using legislation and bibliographies on the subject it is verified that the companies of the State of Espírito Santo do not obey the constitutional principles and the limits to them established and, for that they are respected, it is essential to consider the importance environmental right, as well as the right of the citizen, which are assured in article 6 of our Federal Constitution.	pt_BR
dc.description.sponsorship	O presente trabalho evidenciou relatos da poluição causados pelas mineradoras e industrias que emitem o chamado pó preto na região da Grande Vitória e visa responder ao seguinte questionamento: Quais mecanismos judiciais o cidadão de forma individual pode se utilizar para responsabilizar da emissão do pó preto na Grande Vitória? O artigo irá esclarecer as medidas que poderão ser tomadas pelo poder público, abordar acerca dos Direitos Sociais. Mostrará a importância do termo de ajustamento de conduta na área ambiental, bem com irá tratar da Ação Civil pública, na proteção ao meio ambiente e a Ação Popular, na proteção à saúde, laser ao patrimônio público. Utilizando-se legislações e bibliografias sobre o tema verifica-se que as empresas do Estado do Espírito Santo não obedecem aos princípios constitucionais e os limites a elas estabelecidos e, para que sejam respeitados, é imprescindível considerar a importância direito ambiental, bem como o direito do cidadão, a qual estão assegurados no artigo 6º da nossa Constituição Federal.	pt_BR
