dc.description.abstract	The present paper aims to answer the following question: Does the criminalization of abortion proposed in the Penal Code of 1940 violate women's fundamental rights and still reflects on their human dignity? The article analyzes the possibility of curtailing the fundamental rights of women with a reflection on human dignity imposed by the criminalization of abortion. Using legislations and bibliographies on the subject, it is verified that the criminalization of abortion, besides impacting women's rights, can not effectively protect the right to life of the embryo. Criminalization is incompatible with fundamental rights, including the sexual and reproductive rights of women, which can not be forced by the State to maintain an unwanted pregnancy. In addition to the feminine autonomy, which should preserve the right to make its existential choices; the physical and psychic integrity of the pregnant woman, who suffers in her bodyand her psyche the effects of pregnancy; and the equality of women by full gender equality that depends on respecting their will in this matter.	pt_BR
dc.description.sponsorship	O presente trabalho visa responder ao seguinte questionamento: A criminalização do aborto proposto no Código Penal de 1940 fere os direitos fundamentais da mulher e ainda reflete na sua dignidade humana? O artigo analisa a possibilidade do cerceamento dos direitos fundamentais das mulheres com reflexos na dignidade humana imposto pela criminalização do aborto. Utilizando-se legislações e bibliografias sobre o tema verifica-se que a criminalização do aborto além de impactar nos direitos da mulher, não consegue tutelar de forma eficaz o direito à vida do embrião. A criminalização é incompatível com os direitos fundamentais, dentre eles, os direitos sexuais e reprodutivos da mulher, que não pode ser obrigada pelo Estado a manter uma gestação indesejada. Além da autonomia feminina, que deve conservar o direito de fazer suas escolhas existenciais; a integridade física e psíquica da gestante, que é quem sofre, no seu corpo e no seu psiquismo, os efeitos da gravidez; e a igualdade da mulher pela equiparação plena de gênero que depende de se respeitar sua vontade nessa matéria.	pt_BR
