Abstract:
The issueofthe abordo is a subjectthathasbeen widely discussed, since it is linked to social, religious, economic and legal values. This issue is controversial and has been discussed to stop being a crime, that is, what is wanted is the decriminalization of abortion in Brazil, given the current criminal code criminalizes the practice of abortion as a crime. Considering the great repercussion caused by the STF in a decision decriminalizing abortion in the first trimester of pregnancy, it was decided to carry out the study on the aspects that involve this practice in our country. Another important factor is the right to life of the unborn child provided for by the civil code and by the Federal Constitution versus the principle of the dignity of the human person. In order to enrich the research, jurisprudence and doctrines have been brought to reflect on the unconstitutionality of the principle of the dignity of the human person andclarifying that this decision violates constitutional principles and guarantees. Clarifying that this principle has support in the Federal Constitution and International Treaties, as well as an analysis of the concept of abortion and the conjecture of illegal and legal abortion
