dc.description.abstract	Pets have assumed an important role within families and in societies. Thus, before a conjugal dissolution or rupture of the stable union, the analysis of the legal situation of the pets began to draw the attention of the Brazilian courts. In this sense, the present work aims to answer the following question: Is it possible to institute custody of the pet, in case of separation of the couple? Therefore, this will be answered based on the current family evolution in the way the domestic animal is treated by society where it is clear that they can not be considered as simple thing in the relationship developed between man and animal in the family environment. Making clear the need for a new creation of legal protection distinct from the one that already exists. This is a deductive research in theoretical and qualitative research using bibliographical and legal documentary material.	pt_BR
dc.description.sponsorship	Os animais de estimação têm assumido um importante papel dentro das famílias e nas sociedades. Com isso, diante de uma dissolução conjugal ou ruptura da união estável a análise da situação jurídica dos animais de estimação passou a chamar a atenção dos tribunais brasileiros. Nesse sentido, o presente trabalho visa responder ao seguinte questionamento: É possível a instituição da guarda do animal de estimação, caso haja separação do casal titular? Portanto este será respondido com base na atual evolução familiar, na forma como o animal doméstico é tratado pela sociedade, deixando claro que eles não podem ser considerados como simples coisa na relação desenvolvida entre homem e animal no ambiente familiar. Tal fato deixa evidente a necessidade de uma nova criação de tutela jurídica distinta da que já existe. Trata-se de uma pesquisa dedutiva em pesquisa teórica e qualitativa com emprego de material bibliográfico e documental legal.	pt_BR
