Abstract:
This is a study on the proposal of the social security reform from the point of view of
the fundamental rights and guarantees set out in the Federal Constitution, in
particular with respect to the social rights and the principle of ban on social
regression. An analysis of the Constitutional Amendment proposal - PEC n.
287/2016, searches of specialists in the subject, books, editorials and other
bibliographic sources. The development of the article discusses the "reformist"
proposal in the critical perspective of the violation of the fundamental rights and
guarantees of millions of Brazilians who depend on the social security income for
their basic needs. The study identifies the impact on the lives of insured workers and
the risk of loss of fundamental rights guaranteed by the constitution. Therefore, the
need for a broad debate on the subject is indisputable, so that there is no violation of
rights and increase in the misery and poverty of the Brazilian population.
