Abstract:
Propõe-se o estudo no aspecto do Direito Civil, com foco no direito Contratual. A
segurança e confiabilidade elencada pelo uso do Blockchain, viabiliza a utilização dos
smart contracts, que trazem agilidade, comodidade e eficiência, traduzido pela
segurança, ambiente do negócio, redução de custos, diminuição de taxas, ausência
do intermediário. Inova-se a maneira de contratar pela tecnologia blockchain, novo
objeto de relevância ao direito de contratar das instituições, corporações e pessoas.
Por ser meio de contratação inovador incertezas pairam da efetiva tutela do direito
brasileiro sobre os smart contracts. Faz-se pesquisa exploratória das características
dos contratos tradicionais, sobre a égide do direito brasileiro. Alinha-se a busca de
compreender os aspectos de funcionalidade da blockchain e dos smart contracts.
Examina-se as características legais da natureza jurídica dos contratos tradicionais,
disposta dentro de seus planos de existência, validade e eficácia. Verifica-se efeitos e
limitações das obrigações. Compara-se os preceitos erguidos da legalidade contratual
tradicional aos aspectos gerais dos smart contracts de tecnologia blockchain.
Constata-se a juridicidade dos smart contracts de tecnologia blockchain tutelada pelo
direito brasileiro. A auto execução característica dos smart contracts provoca a
irretroatividade da obrigação. Compreende-se que os requisitos de legalidades
devam-se constar nas linhas algorítmicas do smart contract. Verifica-se que eventuais
arrependimentos, correções ou novos acertos entre as partes necessita de novo
contrato. Necessita-se experimentar para averiguar as particularidades jurídicas que
possam surgir nos smart contracts. Percebe-se impossibilidade de exercer certos
direitos durante a execução do smart contract.
