Abstract:
A presente pesquisa visa abordar a aplicação dos métodos de autocomposição – conciliação e mediação – à luz da Lei n.º 13.105/2015 – Novo Código de Processo Civil –, nas ações que figurem como parte a Fazenda Pública. O novo Código de Processo Civil (Lei 13.105/2015) trouxe inovações quanto à priorização da utilização dos métodos de solução de conflitos, como, por exemplo, a indicação de uma audiência de conciliação ou de mediação logo na fase inicial do procedimento comum, antes mesmo do oferecimento de defesa por parte do réu. Estuda a possibilidade de efetivar uma cultura jurídica de mediação e conciliação com a Administração Pública, num meio onde a cultura de litigância predomina, não só em relação aos entes estatais, mas num todo. O problema de pesquisa tem como objetivo analisar se a indisponibilidade do interesse público tem aptidão para impedir a autocomposição pelos entes públicos nas ações em que figurem como parte, sendo selecionados, para tanto, ensinamentos doutrinários a respeito do assunto, por meio de levantamento bibliográfico e jurisprudencial, bem como analisar os principais métodos de autocomposição dos conflitos, como a conciliação e a mediação, com as prerrogativas da Fazenda Pública.
