Abstract:
No presente trabalho, a partir de uma análise no contexto da saúde pública no Brasil, busca-se entender os motivos que têm levado o Poder Judiciário a uma intensa atuação na defesa dos direitos implicados na garantia de prestação de serviços de saúde por parte do Estado. É analisado aqui as questões polêmicas envolvendo a judicialização de políticas públicas na área da saúde, decorrentes de um exacerbado ativismo judicial, apontada pelos críticos como uma ameaça ao Estado Democrático de Direito. A pesquisa parte de um breve histórico da saúde pública no Brasil com a devida legislação aplicada; é seguida por uma análise do direito à saúde como direito fundamental e as políticas públicas envolvidas no assunto. Objetiva-se encontrar, no decorrer desta pesquisa, os pontos favoráveis e desfavoráveis dessa veemente atuação judicial, assim como eficientes instrumentos a serem utilizados na busca de decisões justas e legítimas, porque tomadas a partir de uma efetiva participação popular, quer seja no planejamento das políticas públicas, quanto na elaboração das normas e decisões judiciais afetas à saúde pública, a exemplo das audiências públicas.
