Abstract:
O artigo apresentado tem como objetivo analisar a teoria do valor do desestímulo: sua origem, a Responsabilidade Civil, casos práticos e aplicação no Brasil. Predominante nos países em que o direito se desenvolveu por meio das decisões dos tribunais, e não mediante atos legislativos ou executivos (commom law), a teoria mostra-se, na maioria das vezes, razoável e eficiente no combate a má-fé e abusos de grandes empresas. Embora que seja possível encontrar condenações em danos punitivos entrelaçadas com os danos morais, sua aplicação ainda é muito insegura e incomum, provavelmente pela insuficiência de regulamentação legal. Dessa maneira, procuramos analisar se a teoria é apropriada para o nosso ordenamento jurídico, se concilia com os princípios de nossa Constituição, se sua aplicação encontra restrições legais e se se revelará vantajoso em nossa realidade, combatendo a morosidade, educando os ofensores e a quantidade de processos desnecessários. Para tal, é necessário antes localizar referências legais para sua aplicação, para que os casos equivalentes não passem a ter tratamento diferenciado, nem disponha de enriquecimento ou empobrecimento de uma das partes.
