dc.description	O presente trabalho buscou demonstrar de forma sucinta o poder normativo da Constituição Federal/88, bem como, respeitosamente discordando do entendimento da mais alta corte do ordenamento jurídico pátrio, a possibilidade, através da interpretação jurídica, da inconstitucionalidade do art. 142, §2º da Carta Magna, uma vez que a mesma corte, como será apresentado, já deu uma interpretação relativa ao dispositivo normativo que versa sobre a vedação à aplicação do Habeas Corpus nas transgressões disciplinares militares, aceitando parcialmente o remédio constitucional e rejeitando-o no tocante ao exame do mérito do ato administrativo.	pt_BR
dc.description.abstract	The present work has succinctly demonstrated the normative power of the Federal Constitution / 88, as well as, respectfully disagreeing with the understanding of the highest court of the national court order, the possibility, through legal interpretation, of the unconstitutionality of art. 142, §2º of the Magna Carta, since the same court, as will be presented, has already given an interpretation concerning the normative device that deals with the prohibition of the application of Habeas Corpus in military disciplinary transgressions. Partially accepting the constitutional remedy and rejecting it regarding the examination of the merits of the administrative act.	pt_BR
