O objetivo deste trabalho é de analisar os diferentes entendimentos que cercam
a possibilidade de cumulação dos adicionais de insalubridade com o de
periculosidade.
Entende-se por adicional de insalubridade como uma compensação ao
trabalhador por períodos expostos a agentes nocivos à saúde, já por adicional de
periculosidade entende-se como aquele pago às atividades e operações perigosas,
que por sua natureza impliquem risco acentuado em virtude de exposição do
trabalhador a: inflamáveis, explosivos ou energia elétrica; roubos ou outras espécies
de violência física nas atividades de segurança; atividades em motocicletas; sistema
elétrico de potência em condição de risco; radiação ionizante ou substância radioativa;
bombas de gasolina ou em prédios de construção vertical com armazenamento de
líquido inflamável.
Sendo assim, a CLT, na seção XIII do Capítulo V, traz em seus artigos 189 a
192 as especificações legais responsáveis pelo adicional de insalubridade
determinando o enquadramento e o grau de insalubridade, bem como sua forma de
eliminação ou neutralização.
Quanto ao adicional de periculosidade é o artigo 193 traz um rol de atividades
e operações que configuram a exposição ao perigo ensejador do adicional.
A maior dúvida a respeito dos adicionais paira sobre o §2º do art. 193, da CLT
quando descrever que “O empregado poderá optar pelo adicional de insalubridade
que por ventura lhe seja devido”, contudo, há entendimentos de Tribunais Superiores
relacionados à possibilidade do acúmulo dos referidos adicionais.
