Abstract:
The article will deal with the abuse of authority exercised by police forces from the perspective of the new law No. 13.869/2019, addressing the limits of the exercise of their function. Among the limitations, the characteristics, principles, purpose, as well as the mission of police forces in the democratic state of law will be broadly addressed. The work in question is an analysis of the limit of police power in favor of the preservation of public order versus respect for the fundamental rights guaranteed by the Federal Constitution to the citizen. The research was developed with the purpose of studying the exercise of police activity, capable of exercising it in an efficient, proportional and mainly legal manner, thus meeting the principles of legality, impersonality, morality, publicity and efficiency, so that it does not commit abuse authority in the exercise of its function.

O artigo tratará do abuso de autoridade exercido pelas forças policiais sob a ótica da nova lei nº 13.869/2019, abordando os limites do exercício da sua função. Dentre as limitações serão abordadas de forma ampla as características, princípios, finalidade, bem como a missão das forças policias no estado democrático de direito. O trabalho em comento trata-se de uma análise do limite do poder de polícia em prol da preservação da ordem pública versus o respeito aos Direitos fundamentais assegurados pela Constituição Federal ao cidadão. A pesquisa se desenvolveu com a finalidade de estudar o exercício da atividade policial, capaz de exercê-lo de forma eficiente, proporcional e principalmente legal, atendendo assim aos princípios da legalidade, impessoalidade, moralidade, publicidade e eficiência, para que não cometa o abuso de autoridade no exercício da sua função.
