DIRETIVAS ANTECIPADAS DA VONTADE E A ORTOTANÁSIA, À LUZ DO DIREITO, EM TEMPOS DE COVID-19

Abstract:

The present study is characterized as a bibliographic research, carried out in the legal literature, in order to verify the validity of the Living Will Testament, known as advance directives of Living Will in the Brazilian Legal system, as well as, the institute of orthothanasia, under the Law, in COVID-19 times. To approach the discussion and explanations about the origin of these institutes, characteristics, opportunities for application and their importance as a guarantee of respect for the last will of terminal patients, individual autonomy and the dignity of the human person. To analyze concrete cases that deal with the theme, in order to improve the understanding and complexity of the directive anticipated in times of COVID-19, bringing in this context the role of the family, the doctor and the patient in the scope of the decisions to be taken. And finally, it is concluded that the reduction in the use of artificial therapeutic resources does not constitute a crime, since any other procedures that are used to obtain a longer life span can generate in the patient the loss of his dignity, which is a fundamental right inscribed in our 1988 Constitution.

O presente estudo caracteriza-se como uma pesquisa bibliográfica realizada na literatura jurídica, a fim de verificar a validade do testamento vital conhecido como diretivas antecipadas de vontade no ordenamento jurídico brasileiro, assim como o instituto da ortotanásia à luz do direito, em tempos de COVID-19. Abordar a discussão e explicações acerca da origem dos referidos institutos, características, oportunidades de aplicação e sua importância como garantia de respeito à última vontade dos pacientes terminais, da autonomia individual e da dignidade da pessoa humana. Analisar casos concretos que tratem do tema a fim de melhorar a compreensão e complexidade da diretiva antecipada em tempos de COVID-19, trazendo nesse contexto o papel da família, do médico e do paciente no âmbito das decisões a serem tomadas. E por fim, conclui-se que a redução na utilização de recursos terapêuticos artificiais não se configura crime, pois, quaisquer outros procedimentos que sejam utilizados na obtenção de um maior prazo de vida, podem gerar no paciente a perda de sua dignidade, que é um direito fundamental insculpido em nossa Carta Magna de 1988.
