dc.description	O presente artigo tem por objetivo demostrar as flagrantes irregularidades ocorridas no inquérito 4.781/DF, conhecido como Inquérito das Fake News. O Supremo Tribunal Federal por meio do presidente Dias Tofolli, com fundamento no Regimento Interno do Supremo Tribunal Federal instaurou o Inquérito com o objetivo de investigar possíveis crimes cometidos por meio das redes sociais, figurando como supostas e principais vítimas, os atuais ministros da Suprema Corte brasileira. Assim, o principal objetivo deste estudo é mostrar as diversas falhas e irregularidades que ocorreram no momento em que o inquérito fora instaurado, bem como durante toda a fase de investigação, infringindo os princípios constitucionais. Realizado estudo acerca da temática, restou evidenciado que os princípios constitucionais da imparcialidade e ao princípio do juiz natural, bem como o sistema acusatório processual não foram respeitados. A pesquisa fora realizada em livros de direito constitucionais, direito processual penal, consultas a entrevistas a juristas, livros doutrinários e em sites de imensa relevância no mundo jurídico. Por fim, a pesquisa concluiu que o inquérito das Fake News, de acordo com a Constituição Federal padece além da ideia de ilegalidade, outrossim, de inconstitucionalidade, pois viola o processo acusatório do Código de Processo Penal, afetando a credibilidade, a segurança jurídica, e a supremacia oriunda do pilar do ordenamento Jurídico brasileiro.	pt_BR
dc.description.abstract	This article aims to demonstrate the flagrant irregularities that occurred in the investigation 4.781/DF, known as the Fake News Inquiry. The Federal Supreme Court, through President Dias Tofolli, based on the Internal Regulation of the Federal Supreme Court, initiated the Inquiry with the objective of investigating possible crimes committed through social networks, with the current Supreme Court justices appearing as alleged and main victims. Brazilian. Thus, the main objective of this study is to show the various failures and irregularities that occurred at the time the investigation was initiated, as well as during the entire investigation phase, violating constitutional principles. A study on the subject was carried out, showing that the constitutional principles of impartiality and the principle of the natural judge, as well as the procedural accusatory system, were not respected. The research was carried out in books on constitutional law, criminal procedural law, consultations with interviews with jurists, doctrinal books and on websites of immense relevance in the legal world. Finally, the research concluded that the Fake News inquiry, according to the Federal Constitution, is unconstitutional, as it violates the accusatory process of the Code of Criminal Procedure, affecting credibility, legal certainty, and the supremacy arising from the pillar of the Legal system.
