dc.description	Este artigo científico tem como foco central discorrer sobre a possibilidade de aplicação do instituto da responsabilidade civil nas relações familiares em virtude do abandono afetivo, com destaque para a relação paterno-filial. Para tanto, o artigo utilizou-se de uma abordagem metodológica, qualitativa, de cunho bibliográfico, com estudo de Doutrinas, Legislações, Jurisprudências e análises de decisões dos Tribunais de Justiça. Deste modo, a partir da Carta Magna, o afeto ganhou grande notoriedade, mesmo não sendo um princípio explícito, mas pautado no princípio da dignidade humana. Por isso, é em virtude desse sentimento, que as pessoas ingressam no Poder Judiciário quando ofendidas, buscando assim, a reparação por danos morais em virtude do abandono afetivo. Ocorre que essa possibilidade de indenização é de grande discussão no Ordenamento Jurídico Brasileiro, não havendo ainda um entendimento pacificado sobre o assunto. Pois, há autores que entendem pelo não cabimento de tal indenização, haja vista, que estaria gerando uma “monetização do amor”. Já a corrente favorável, entende que não se trata de impor um preço ao amor, mas sim de reprimir a prática desses atos que geram danos irreversíveis à prole. Assim, há a possibilidade de responsabilização por danos morais em virtude do abandono afetivo paterno-filial, em decorrência dos danos irreparáveis causados na vida da criança e do adolescente, tanto na esfera psíquica, quanto na esfera jurídica, mas, desde que analisado de forma minuciosa cada caso concreto, para assim confirmar o seu cabimento.	pt_BR
dc.description.abstract	This scientific article focuses on discussing the possibility of applying the civil liability institute in family relationships due to emotional abandonment, with emphasis on the father-child relationship. Therefore, the article used a methodological, qualitative, bibliographic approach, with a study of Doctrines, Legislation, Jurisprudence and analysis of decisions by the Courts of Justice. In this way, from the Magna Carta, affection gained great notoriety, even though it was not an explicit principle, but based on the principle of human dignity. Therefore, it is because of this feeling that people enter the Judiciary when offended, thus seeking compensation for moral damages due to emotional abandonment. It so happens that this possibility of indemnification is of great discussion in the Brazilian Legal System, and there is still no pacified understanding on the subject. For, there are authors who understand that such compensation is not appropriate, given that it would be generating a “monetization of love”. The favorable current understands that it is not about imposing a price on love, but about repressing the practice of those acts that cause irreversible damage to the offspring. Thus, there is the possibility of liability for moral damages due to the paternal-filial emotional abandonment, as a result of the irreparable damage caused in the life of the child and adolescent, both in the psychic sphere and in the legal sphere, but provided that it is analyzed in a way detailed each specific case, in order to confirm its suitability.	pt_BR
