A Lei nº 7.210/1984, mais conhecida como Lei de Execução Penal, estabelece que a execução da
pena vai além da punição, buscando reabilitar os indivíduos e prepará-los para um retorno
bem-sucedido à sociedade, consequentemente, enfatizando um suposto potencial transformador
do sistema de justiça criminal. No entanto, há décadas o sistema prisional brasileiro enfrenta uma
grave crise, marcada por superlotação, condições insalubres e desumanas, violência, e, sobretudo,
pela ausência de programas de ressocialização. A privação da liberdade não pode significar a
exclusão social do preso, sendo essencial que o mesmo tenha a prestação de assistência por parte
do Estado, visando justamente a sua reintegração social, de maneira pacífica e harmônica. Por
esse ângulo, a educação se apresenta como uma importante ferramenta para a concretização dessa
finalidade. Porém, uma parcela irrisória dos detentos tem acesso a esse tipo de assistência, haja
vista serem poucos os estabelecimentos prisionais que dispõem de espaço, material pedagógico e
professores. Diante disso, o presente artigo científico tem como finalidade discorrer sobre a
educação como instrumento de ressocialização nas unidades prisionais, ponderando a sua
relevância e qual seria a melhor forma de implementá-la. Para tanto, torna-se fundamental
desempenhar um panorama sobre a crise no sistema prisional brasileiro, descrever aspectos
preliminares da execução penal, pormenorizar a assistência ao preso, e elencar os benefícios da
educação para fins de ressocialização do preso. A escolha da respectiva temática pode ser
justificada pelo fato de o sistema prisional brasileiro enfrentar diversos problemas que refletem
diretamente na vida dos detentos, prejudicando a finalidade primordial da execução da penal,
qual seja, a ressocialização do detento. Quanto aos procedimentos metodológicos, o estudo se
restringe a uma pesquisa qualitativa, fundamentada pelo método dedutivo, empregando como
técnica de pesquisa a revisão bibliográfica. |

Law No. 7,210/1984, better known as the Penal Execution Law, establishes that the execution of
the sentence goes beyond punishment, seeking to rehabilitate individuals and prepare them for a
successful return to society, thereby emphasizing a supposed transformative potential of the
criminal justice system. However, for decades, the Brazilian prison system has faced a severe
crisis characterized by overcrowding, unsanitary and inhumane conditions, violence, and, above
all, the absence of reintegration programs. Deprivation of liberty cannot mean the social
exclusion of the inmate, and it is essential that they receive assistance from the State, aiming
precisely at their peaceful and harmonious social reintegration. From this perspective, education
presents itself as an important tool for achieving this purpose. However, only a negligible fraction
of inmates has access to this type of assistance, given that few correctional facilities have the
necessary space, teaching materials, and teachers. In light of this, the present scientific article
aims to discuss education as an instrument of reintegration in prison units, considering its
relevance and the best way to implement it. Therefore, it is essential to provide an overview of
the crisis in the Brazilian prison system, describe preliminary aspects of penal execution, detail
prisoner assistance, and list the benefits of education for the purpose of prisoner reintegration.
The choice of this theme can be justified by the fact that the Brazilian prison system faces various
problems that directly impact the lives of inmates, hindering the primary purpose of penal
execution, which is the rehabilitation of the inmate. As for the methodological procedures, the
study is limited to qualitative research, based on the deductive method, employing literature
review as the research technique. |
