Abstract:
Due to the constant growth in the number of users on social media and the increased
personal interaction and exposure, the commission and propagation of hate speech in
the virtual environment have become prevalent, as seen in the case of the X platform
(formerly Twitter). Therefore, this thesis aims to clarify the real responsibility of digital
platforms in controlling and combating such hate speech, while safeguarding freedom
of expression as provided in the Constitution. It also seeks to draw a parallel between
hate speech and freedom of expression. Finally, it was necessary to study cases,
decisions, and jurisprudence that highlight the growth of hate speech and the legal
responsibility of digital platforms in addressing this crime.

Em razão do constante crescimento no número de usuários nas redes sociais e a
maior interação e exposição pessoal destes, desencadeou-se o cometimento e a
propagação de discursos de ódio no ambiente virtual, como no caso da plataforma X
(antigo twitter). Para tanto, o presente trabalho de conclusão de curso tem por objetivo
elucidar qual a real responsabilidade das plataformas digitais no controle e combate a
esses discursos de ódio, praticados por seus usuários, resguardando a liberdade de
expressão, haja vista a previsão Constitucional, além de fazer um paralelo entre o
discurso de ódio e a liberdade de expressão. Por fim, fez-se necessário o estudo de
casos, decisões e jurisprudência que evidenciassem o crescimento dos discursos de
ódio e a responsabilidade jurídica das plataformas digitais e sua atuação no combate
ao cometimento desse delito.
