Abstract:
This study aims to analyze whether the right to freedom of expression can be used
as a justification for committing crimes against honor in the digital environment.
Initially, it examines freedom of expression and the right to honor as fundamental
rights enshrined in the Federal Constitution, as well as the concepts of cybercrimes
and offenses against honor that are punishable under Brazilian law. Following the
presentation of these concepts, the study explores how conflicts between two or
more fundamental rights are resolved. Finally, it seeks to determine whether freedom
of expression can be invoked as a justification for such crimes, considering that this
right has boundaries and cannot be regarded as absolute

O presente trabalho busca analisar se é possível a utilização do direito à liberdade
de expressão como justificativa para a prática de crimes contra a honra no ambiente
digital. Inicialmente, faz-se uma análise acerca da liberdade de expressão e do
direito à honra como direitos fundamentais expressos na Constituição Federal, bem
como os conceitos de cibercrimes e os crimes contra a honra puníveis no
ordenamento jurídico brasileiro. Após a exposição desses conceitos, descrevemos
como é solucionado quando dois ou mais direitos fundamentais entram em conflito.
Por fim, buscou-se analisar se a liberdade de expressão pode ser utilizada como
justificativa para a prática de tais crimes, uma vez que tal direito encontra limites e
não pode ser visto como absoluto.
