Abstract

This work aims to analyze the validity of the dating contract and its relationship with the transition to the stable union. The legal implications in the context of the Brazilian legal system will be discussed. Considering the growing use of this type of contract between couples who wish to avoid the legal recognition of a stable union, questions arise about its effectiveness and validity. The study seeks to understand the reasons why many adopt this practice, with the intention of ensuring the autonomy of affective relationships and avoiding possible legal consequences of a stable union. The research will also examine how the dating contract is interpreted in Brazilian law and the legal controversies surrounding its application. The study will examine the way in which the dating contract is addressed by current legislation and doctrinal currents, observing divergences between the positions of jurists. An analysis of the criteria applied by jurisprudence to differentiate dating from stable union will be carried out, paying attention to the points that generate more controversies in the current legal scenario. The article, based on a critical analysis of doctrine, jurisprudence and legislation, seeks to contribute to the understanding of legal issues related to the formalization of the dating contract and its eventual transition to the stable union.
