Abstract:
This article will address the peculiarities of child labor in artistic activities, examining,
in particular, the functioning of Artistic Child Labor in Brazil, which continues to exist
despite the explicit prohibition in the Federal Constitution against any type of work for
minors. Therefore, the objective of this study is to promote reflection on whether young
artists are losing their childhood in favor of economic interests, and to analyze the
impacts of a possible early "adultization", in addition to questioning whether Artistic
Child Labor is in line with the full protection guaranteed to children and adolescents by
article 227 of the Federal Constitution, and which body of the Judiciary is competent
to authorize and judge cases involving the participation of children and adolescents in
artistic activities. In view of this, using qualitative, bibliographic and documentary
methodology, it is expected to demonstrate the necessary legislative review on the
topic to preserve childhood and avoid the different types of violence that children and
adolescents can suffer within children's artistic work.

O presente artigo abordará as peculiaridades do trabalho infantil em atividades
artísticas, examinando, em especial, o funcionamento do Trabalho Infantil Artístico no
Brasil, que continua a existir apesar da proibição explícita na Constituição Federal
contra qualquer tipo de trabalho para menores. Sendo assim, o objetivo deste estudo
é promover a reflexão sobre se os jovens artistas estão perdendo sua infância em prol
de interesses econômicos, e analisar os impactos de uma possível "adultização"
precoce, além de questionar se o Trabalho Infantil Artístico está em consonância com
a proteção integral garantida às crianças e adolescentes pelo artigo 227 da
Constituição Federal, e qual órgão do Poder Judiciário é competente para autorizar e
julgar os casos envolvendo a participação de crianças e adolescentes em atividades
artísticas. Diante disso, utilizando-se a metodologia qualitativa, bibliográfica e
documental, espera-se demonstrar a necessária revisão legislativa sobre o tema para
preservar a infância e evitar os diversos tipos de violência que crianças e adolescentes
podem sofrer dentro do trabalho artístico infanto-juvenil.
