Abstract:
Cybercrimes have become increasingly common in a progressively more digitalized
world, where technology and the Internet are an integral part of everyday life. In this
context, it is worth noting that children and adolescents are increasingly connected to
the Internet, using it to carry out activities in their daily lives. This research seeks to
analyze the challenges in enforcing the law in cases of online child pornography.
Therefore, the objective of this research is to identify possible gaps in Brazilian
legislation, analyze the difficulties faced by public agencies in investigating and
punishing the crime in question, and evaluate the effectiveness of the prevention
strategies adopted. In addition, this research seeks to investigate the relevant Brazilian
legislation, such as the Child and Adolescent Statute (ECA), the Federal Constitution
of 1988 (CRFB/88) and other laws related to child protection, in order to evaluate their
effectiveness in preventing and repressing virtual crimes against children and
adolescents, especially the most vulnerable group.

Os crimes digitais têm se tornado cada vez mais habituais em um mundo
progressivamente mais digitalizado, onde a tecnologia e a internet são partes
integrantes do cotidiano. Nesse contexto, destaca-se que crianças e adolescentes
estão cada vez mais conectados à rede, utilizando-a para realizar atividades na sua
rotina. Esta pesquisa busca analisar os desafios na aplicação da lei em casos de
pornografia infantil on-line. Com isso, o objetivo dessa pesquisa está relacionado na
identificação de eventuais lacunas existentes na legislação brasileira, análise das
dificuldades enfrentadas pelos órgãos públicos na investigação e punição do delito em
questão e avaliação da eficácia das estratégias de prevenção adotadas. Além disso,
esta pesquisa procura investigar a legislação brasileira pertinente, como o Estatuto da
Criança e do Adolescente (ECA), a Constituição Federal de 1988 (CRFB/88) e outras
leis relacionadas à proteção infantil, com o intuito de avaliar sua eficácia na prevenção
e repressão de delitos virtuais contra crianças e adolescentes, notadamente, grupo
mais vulnerável.
