Abstract:
One of the branches of civil law is succession law, which begins to take effect upon
death. With the need to understand the transmission of the deceased's assets and
considering the increasingly growing use of technologies, it became necessary to analyze
how the Brazilian legal system behaves in relation to the issue of digital inheritance. The
fact is that the topic is very new and not very positive, but it is necessary for the law to
adapt to society, which makes this study relevant and current. To achieve the proposed
objective, bibliographical research was carried out, through the analysis of several articles
related to the topic and Brazilian legislation, as well as the use of jurisprudential
information obtained from the official websites of the higher courts.

Um dos ramos do direito civil é o direito das sucessões, que começa a produzir efeitos
a partir do evento morte. Com a necessidade de entender a respeito da transmissão
dos bens do falecido e considerando o cada vez mais crescente uso das tecnologias,
tornou-se necessário analisar como o ordenamento jurídico brasileiro se comporta
frente à temática da herança digital. Fato é que o tema é muito novo e pouco
positivado, porém é necessário que o direito se adeque à sociedade, o que torna este
estudo relevante e atual. Para atingir o objetivo proposto, foi realizada pesquisa
bibliográfica, por meio da análise de diversos artigos relacionados ao tema e da
legislação brasileira, bem como utilização de informações jurisprudenciais obtidas nos
sites oficiais dos tribunais superiores.
