Abstract:

The Maria da Penha Law was established with the aim of protecting women against violence that occurs within the domestic and family sphere, establishing measures to protect their integrity by avoiding the aggressor from their lives. This legislation brought several innovations, such as expanding the definition of domestic and family violence, providing protective measures for victims, criminalizing various forms of violence directed at women, among other measures. Over the years, this Law began to be used by many women. However, in some cases, their employment is not fair. Some women, for example, take the opportunity to promote revenge. In this work, we will address these situations in which women benefit unduly from this law and, consequently, from the application of protective measures for incorrect purposes and the losses that this inappropriate use causes, undermining confidence in the Brazilian legal system and compromising the effectiveness of the laws of protection against domestic violence, whose main objective is the safety of women in these situations

A Lei Maria da Penha foi instituída com o objetivo de salvaguardar a mulher contra a violência que ocorre no âmbito doméstico e familiar, estabelecendo medidas para pro- teger sua integridade ao afastar o agressor de seu convívio. Essa legislação trouxe diversas inovações, como a ampliação da definição de violência doméstica e familiar, a previsão de medidas protetivas para as vítimas, a criminalização de várias formas de violência dirigidas às mulheres, entre outras medidas. Com o decorrer dos anos, a referida Lei passou a ser utilizada por muitas mulheres. No entanto, em alguns casos, seu emprego não se dá de maneira justa. Algumas mulheres, por exemplo, aproveitam-se da oportunidade para promover a vingança. Neste trabalho, abordaremos es- sas situações em que mulheres se beneficiam indevidamente desta lei e, por consequência, da aplicação de medidas protetivas com propósitos incorretos e os prejuízos que esse uso inadequado acarreta, minando a confiança no sistema jurídico brasileiro e comprometendo a eficácia das leis de proteção contra a violência doméstica, que têm como principal objetivo a salvaguarda das mulheres nessas situações.
