Abstract:
The present study addresses the historical evolution of testimonial evidence and how
the justice system had to adapt to the pandemic context through the creation of
mechanisms such as the "100% Digital Court". The analysis discusses the benefits of
technology, such as procedural speed and resource efficiency, but also highlights the
risks, such as the violation of witness incomunicability and third-party interference.
Additionally, it explores the issue of judicial impartiality, which is fundamental to
ensuring a fair decision that respects the procedural rights of the parties. Although
videoconference hearings have facilitated access to justice and modernized the
process, it is necessary to establish limits and ensure security mechanisms that protect
the integrity of testimonial evidence. The aim is to promote a balance between
technology and the fundamental principles of the legal process, ensuring the
effectiveness of judicial protection (OpenAI, 2024).
