Direito de acesso à justiça: o desafio da assistência jurídica pública aos detentos diante da escassez de recursos

Abstract

This work investigates the limitations faced by the Public Defender's Office, which make it difficult to provide legal assistance to prisoners in Brazil, especially in the face of budget restrictions and a lack of defenders, questioning whether the increase in demand has been accompanied by the proportional growth of the budget allocated to this body. The methodology used employs documentary analysis and bibliographic review of laws, studies and government data to assess the impact of this disparity on prisoners' right to access to justice. The objective is to understand how the lack of resources and infrastructure compromises the Defender's Office's ability to guarantee effective legal assistance, especially when compared to the Public Ministry, whose structure is more robust. The research concludes that, without adequate reinforcement, the Public Defender's Office continues to be overloaded, limiting the right of convicts to a fair trial and exposing social and legal vulnerability. This reality reinforces the urgent need for budgetary reforms for a more accessible and equitable justice system.
