Abstract:
This study analyzes the influence of structural racism on judicial decisions made by
the 6th Criminal Court of Vila Velha/ES, with an emphasis on cases related to drug
trafficking. The research covers judicial proceedings from the year 2023, analyzing
how racial factors interfere in conviction and acquittal sentences. It is observed that
structural racism permeates both police approaches and judicial decisions, culminating
in the disproportionate criminalization of black individuals. The methodology adopted
includes quantitative and qualitative data analysis, revealing inequalities in the
application of Law No. 11,343/2006. It is concluded that the Brazilian penal system, by
reinforcing racial stereotypes, demands structural reforms that promote greater equity
and social justice.

Este estudo analisa a influência do racismo estrutural nas decisões judiciais proferidas
pela 6ª Vara Criminal de Vila Velha/ES, com ênfase nos casos relacionados ao tráfico
de drogas. A pesquisa abrange processos judiciais do ano de 2023, analisando como
fatores raciais interferem nas sentenças condenatórias e absolutórias. Observa-se
que o racismo estrutural permeia tanto as abordagens policiais quanto as decisões
judiciais, culminando na criminalização desproporcional de indivíduos negros. A
metodologia adotada inclui análises quantitativa e qualitativa dos dados, revelando
desigualdades na aplicação da Lei nº 11.343/2006. Conclui-se que o sistema penal
brasileiro, ao reforçar estereótipos raciais, demanda reformas estruturais que
promovam maior equidade e justiça social.
