Abstract:
This scientific article aims to delve into the fundamental rights of animals as sentient
beings, recognizing their capacity to feel, experience emotions, and sensations. It
also emphasizes the significance of these beings for environmental balance. In this
regard, the research explores the evolution of the rights of non-human animals,
addressing their recognition in both legal systems and society. Despite having their
rights protected by legislation, often the rights of animals are not adequately
respected by society, disregarding the fact that animals have the right to a dignified
life. Therefore, the article intends to analyze the effectiveness of these fundamental
rights through legislation, doctrines, and other relevant research.

O presente artigo científico busca aprofundar os direitos fundamentais dos animais
como seres sencientes, reconhecendo sua capacidade de sentir, experimentar
emoções e sensações. Também enfatiza a relevância desses seres para o equilíbrio
ambiental. Nesse sentido, a pesquisa explora a evolução dos direitos dos animais
não humanos, abordando seu reconhecimento tanto no ordenamento jurídico quanto
na sociedade. Apesar de terem seus direitos resguardados na legislação, muitas
vezes os direitos dos animais não são adequadamente respeitados pela sociedade,
sendo deixado de lado o fato de que os animais têm direito a uma vida digna.
Portanto, o artigo se propõe a analisar a efetividade desses diretos fundamentais,
por meio de legislação, doutrinas e demais pesquisas relevantes.
