Abstract:

Much is questioned about the rights of animals, considering the scientific definition that they are beings that do not have intelligence. However, the most recent understanding addresses that they are beings that enjoy sentience, which is the ability to feel and act in a certain way so that some need is satisfied. From this point of view, animals must have their physical integrity respected by human beings, and the paradigm of man's superiority over animals must be completely broken. The composition of current society addresses that rights must be strictly preserved through the legal provisions already available in the Brazilian legal system. In view of this, the main object of discussion in this approach is the obligation to report animal abuse by condominiums and commercial establishments in the city of São Paulo, established by Law No. . The discussion revolves around the criminal sphere and there is a need to talk about imprisonment, as well as a fine. Similarly, there is an approach from the perspective of environmental law, where it is likely that the practice of mistreatment of animals is a factor of deterioration of the environment, considering the disrespect for fauna, even if they are domestic animals. Further on, it is noted that the practice of abuse is still a current and recurring problem in Brazilian society.

Muito se é questionado acerca dos direitos dos animais, considerando a definição científica de que são seres que não possuem inteligência. Contudo, o entendimento mais recente aborda que são seres que gozam de senciência, sendo essa a capacidade de sentir e agir de determinada forma para que alguma necessidade seja satisfeita. Nessa ótica, os animais devem ter sua integridade física respeitada pelos seres humanos e, deve-se quebrar por completo o paradigma da superioridade do homem em relação aos animais. A composição da sociedade atual aborda que os direitos devem ser rigorosamente preservados por meio dos dispositivos legais já disponíveis no ordenamento jurídico brasileiro. Diante disso, o objeto principal de discussão na presente abordagem é a obrigatoriedade da denúncia de maus tratos à animais por parte dos condomínios e estabelecimentos comerciais da cidade de São Paulo, instituída pela Lei nº 17.477/2021, e tendo em vista a obrigação de fazer. A discussão gira em torno da esfera penal e há que se falar em pena de reclusão, bem como multa. Analogamente, tem-se a abordagem sob a ótica do direito ambiental, onde é passível que a prática de maus tratos a animais seja um fator de deterioração do ambiente, considerando o desrespeito a fauna, ainda que se tratem de animais domésticos. Mais adiante, denota-se que a prática de maus tratos ainda é problema atual e recorrente na sociedade brasileira.
