dc.description	A imparcialidade do juiz em sua atuação de ofício possui enorme influência e impacto sobre o cumprimento das decisões provenientes do magistrado. Por esta razão, a garantia da efetividade das decisões emanadas dentro dos princípios estabelecidos juridicamente inclui, de forma direta, a determinação das medidas indutivas, coercitivas, mandamentais ou sub-rogatórias necessárias no respectivo processo com a principal finalidade de assegurar o cumprimento da ordem judicial. Dentre os incontáveis deveres jurisdicionais propostos pelo Código de Processo Civil, dá-se vazão ao aumento considerável dos poderes executórios do juiz e ao questionamento acerca da influência destes deveres na promulgação decisória final. Deste modo, o presente artigo foi promovido a partir do estudo sobre o posicionamento das cortes superiores quanto as referidas ordens mandamentais, considerando-se o constitucionalismo contemporâneo atual e a garantia da dignidade da pessoa humana a fim de proteger o indivíduo contra a arbitrariedade do Estado, o que não pode mais ser admitido, sob pena de se causar retrocesso social.	pt_BR
dc.description.abstract	The impartiality of the judge in his ex officio performance has enormous influence and impact on the fulfillment of the decisions coming from the magistrate. For this reason, guaranteeing the effectiveness of decisions issued within the principles legally established includes, directly, the determination of inductive, coercive, mandatory or subrogatory measures necessary in the respective process with the main purpose of ensuring compliance with the court order. Among the countless jurisdictional duties proposed by the Civil Procedure Code, there is a considerable increase in the executive powers of the judge and the questioning about the influence of these duties in the final decision-making. In this way, the present article was promoted from the study on the positioning of the superior courts regarding the aforementioned mandatory orders, considering the current contemporary constitutionalism and the guarantee of the dignity of the human person in order to protect the individual against the arbitrariness of the State, which can no longer be admitted, under penalty of causing social backlash.	pt_BR
