Its treatment includes strategies such as surgery, chemotherapy, radiotherapy and targeted therapies, with mastectomy standing out, although this technique is associated with complications such as lymphedema and chronic pain. Methods such as manual lymphatic drainage (MLD) and kinesiotherapy have shown efficacy in controlling lymphedema, in functional recovery and in improving the quality of life of patients, contributing to greater autonomy in daily life. In addition, the advancement of technologies such as virtual reality (VR), artificial intelligence (AI) and wearable devices have revolutionized oncological rehabilitation, allowing personalized interventions and continuous monitoring. These tools expand therapeutic possibilities and promote an approach that is more tailored to individual needs. A multidisciplinary approach, involving professionals such as physiotherapists, psychologists and nutritionists, is essential to provide comprehensive care, addressing the physical, emotional and social aspects of patients. According to data from the World Health Organization (WHO), breast cancer is the most common type of cancer among women worldwide, with more than 2.3 million cases diagnosed annually, highlighting the importance of effective preventive and therapeutic strategies. Based on a systematic review of 23 articles published between 2020 and 2024, it was concluded that the combination of traditional techniques, emerging technologies and self-care practices favors a more complete and humanized recovery, reaffirming the importance of holistic strategies in oncology. The research employed a systematic literature review, drawing on bibliographic and documentary sources, complemented by an analysis of national and international legal frameworks and a case study. The findings reveal substantial challenges to the protection of these women’s rights, including inadequate access to healthcare, the erosion of the mother– child bond, and severe prison overcrowding. The results underscore the pressing need for the implementation of more effective public policies to safeguard the rights of incarcerated women and their children, fostering the humanization of the prison system and the social reintegration of these mothers. This study's general objective was to discuss the limits of criminal liability for medical error in the negligent modality, specifically due to imprudence and negligence. Aspects related to medical errors were discussed, as well as the analytical concept of crime and the actual punishment suffered by these professionals when committing such negligent crimes. The methodology was explanatory and qualitative, survey, developed from books, scientific articles, laws, and decisions from the Courts. The practice of medicine, by involving risks to human life, imposes on the professional the duty to act with diligence, under penalty of liability in the administrative, civil, and criminal spheres. The importance of a careful analysis of the elements that constitute medical error is highlighted, especially in the criminal sphere, where proving fault is complex and convictions are rare and, generally, lenient. Thus, the law should aim not only to punish but also to guide medical conduct. Description: O erro médico representa um tema pautado pela interdisciplinaridade, sendo relevante no âmbito do Direito. O presente trabalho teve como objetivo geral discutir sobre os limites da responsabilidade penal por erro médico, na modalidade culposa, por imprudência e negligência. Foram discutidos os aspectos que se referem aos erros médicos, bem como o conceito analítico de crime e a efetiva punição sofrida por esses profissionais ante o cometimento desses crimes culposos. A metodologia foi a pesquisa explicativa, de caráter qualitativo, elaborada a partir de livros, artigos científicos, leis e decisões dos Tribunais. The study aims to analyze the hypervulnerability of elderly people, examine the relationship between overindebtedness and digital adhesion contracts, and evaluate the application of civil liability in the Consumer Protection Code. The methodology is bibliographic and documentary, and the results indicate the need to strengthen legal protection for elderly consumers.
