Abstract:
In summary, this paper aims to answer the following question: Does the dignity of the human person offend the fact that there is no legal deadline for the victim to perform legal abortion? The article makes a comparison between the legal understanding and the understanding of medicine, demonstrating that the medical opinion stipulates a term for the interruption of pregnancy and also tends to request legal documents as evidence of what happened to the victim, while the legal scope only provides the withdrawal of the fetus, not imposing any deadline to carry out the termination of pregnancy or even some document for the victim to prove the sexual violence suffered. Doctrinal and jurisprudential concepts will be addressed, as well as bills already in process and will also address research that analyzes the reality inhospitals across the country in order to address the problem presented in an attempt to create a solution to the conflict.
