dc.description.abstract	This legal article aims to carry out a critical analysis on the application of the principle of the best interest of the child and the adolescent in the processes of adoption originated by homoaffective couples, as well as to explore the provisions that protect the minor, as well as to highlight the omission of legislators in relation to the right of homosexual couples. It is noted that there is no defined concept of what would be the best interest of the child and the adolescent, making the interpreter uses subjective factors to effect the best interest. Finally, it is intended to make a study on the principle of the best interest to arrive at a defined concept, with the purpose of attending the underprivileged minor.	pt_BR
dc.description.sponsorship	O presente artigo jurídico tem como objetivo realizar uma análise crítica sobre a aplicação do princípio do melhor interesse da criança e do adolescente nos processos de adoção originados por casais homoafetivos, bem como explorar os dispositivos que protege o menor, como também evidenciar a omissão dos legisladores em relação ao direito dos pares homoafetivos. Nota-se que não há um conceito definido do que seria o melhor interesse da criança e do adolescente, fazendo com que o intérprete se utiliza de fatores subjetivos para efetivar o melhor interesse. Por fim, pretende-se fazer um estudo sobre o princípio do melhor interesse para se chegar a um conceito definido, com o propósito de atender o menor desamparado.	pt_BR
