Abstract:
A eutanásia corresponde ao que, etimologicamente, denomina-se por “boa
morte”, consistindo na morte propositalmente provocada por ação médica a fim de
abreviar a vida de um enfermo terminal que, diante dos padrões medicinais vigentes,
é incapaz de sobreviver. Contudo, o abreviamento intencional de uma vida defronta-
se com o direito à vida, o qual desdobra-se no direito de estar biologicamente vivo e,
também, na dignidade da pessoa humana. Lado outro, a autonomia do paciente
corresponde a um dos princípios da bioética, previsto no Relatório Belmont e
incorporado ao direito brasileiro através da Resolução n° 196, de 10 de outubro de
1996, do Conselho Nacional de Justiça, o que determina que a vontade do paciente
ou de quem por ele responda, deve ser considerada de forma livre à influência externa
ou coação. Por conseguinte, a presente monografia tem por objetivo analisar a
eutanásia à luz do princípio da dignidade da pessoa humana e em atenção ao direito
à vida considerando, também, os princípios do Biodireito e da Bioética.
