Abstract:
O presente trabalho tem como objetivo analisar o impacto da Reforma Trabalhista com a permissão da modalidade de contrato de trabalho intermitente em relação à condição social do trabalhador e suas garantias previstas no Art. 7º da Constituição Federal, considerando também as perspectivas dos benefícios para o Empregador. Através da modalidade do trabalho intermitente que teoricamente veio para flexibilizar o empresário e equiparar o trabalhador com o empregador, já que o trabalhador se apresenta mais vulnerável numa relação de trabalho, frente ao poder econômico e diretivo do empregador. A reforma trouxe alguns casos que retratam exceção ao princípio da primazia da realidade, para tanto se destaca o empregado, no qual seja enquadrado como trabalhador intermitente basta que celebre o contrato de trabalho intermitente com o empregador, mesmo que inicialmente trabalhe de forma continuada (art. 452-A CLT). Entendendo que o trabalho intermitente é considerado uma prestação de serviço quando as empresas estão com muita demanda ao cliente e solicitam pessoas para prestar intermitência com o objetivo de acelerar ou lucrar mais no setor econômico.
