Abstract:
É cediço que, quando do falecimento do(a) segurado(a) de algum regime previdenciário, os seus dependentes serão os beneficiários de sua pensão por morte. Dentre os seus dependentes, com foco principal no filho, desde que este seja menor de 21 anos ou maior inválido ou que tenha deficiência intelectual, mental ou grave, fará jus à percepção do benefício deixado pelos pais instituidores, tradicionalmente duas pessoas. Contudo, a multiparentalidade tem sido cada vez mais praticada, principalmente após a publicação do Provimento 63/2017 do CNJ, o qual permitiu o registro de até dois pais e/ou duas mães no campo “filiação”, no registro de nascimento. Desta forma, a presente pesquisa tem como objetivo geral a investigação da possibilidade de um dependente ser beneficiário de até quatro pensões por morte – caso esteja inserido em uma família multiparental. Sendo possível o recebimento, investiga-se, ainda, a natureza da dependência econômica: se presumida, como ocorre com o filho biológico e/ou adotivo, ou se seria necessária a sua comprovação.
