O CARÁTER PERPÉTUO DA MEDIDA DE SEGURANÇA DE INTERNAÇÃO

Abstract

This paper aims to answer the following question: Can the security measure of hospitalization be considered a violation of the constitutional rule to prohibit the imposition of penal sanctions perpetual character? The article makes an analysis of the types of security measures and their consequences in the legal order of the country, using doctrines and procedural practices that guide the subject, so that the hidden side of such measures is revealed, which for many may be a violation of the Magna Carta, but with a deeper study it is possible to see a way to ward off the danger of society for a longer time, even perpetually.
