Abstract

The present paper aims to answer the following question: To what extent does the absence of a law that deals specifically with punishment to psychopaths contribute to recidivism? The purpose of this article is to present and discuss psychopathy, through legal and forensic bias, as a psychological disorder that has frightened and frightened society since ancient times, mainly due to the ineffectiveness of the penalties applied, since cases of recidivism of persons who have the disturbance of psychopathy is greater. The thematic clipping will cover the study of psychopathy in the field of Criminal Law with the help of Forensic Psychology, so that it is possible to make an analysis of the offender, his criminal conduct and the circumstances of the crime, distinguishing between the psychopath and the one who is considered sociopata, aiming at creating more appropriate laws and for these cases.
