Abstract

Legal activism allows the judge to maneuver and shape the legal system, so that the result is predictable, and according to his conviction, going beyond ethical and legal limits, highlighting in this practice the abusive use of the legal system for various purposes as provided for in our Constitution, including in this paradigm the practice of lawfare, legal mechanism for political purposes, used in large measure by the Lava Jato Operation Task Force in Curitiba, the judge's commitment to convict the independent accused of having committed a crime or not, the use of the press also committed and of enormous relevance, because without it there is no way to disqualify the opponent and get popular support.
