A INFLUÊNCIA DA MÍDIA NO TRIBUNAL DO JÚRI

Abstract

The present research seeks to analyze the influence of the media in the judgment made by the Sentencing Council in face of the principles and guarantees applicable to the criminal process that are relativized in the procedure of the Court of the Jury. For that, an exploratory methodology was used to collate the understanding of renowned jurists through a study of the doctrine and analysis of the Brazilian legislation on the subject. Initially, the work addresses the origin of the Jury's Court, registering the current system that involves it. In addition, it analyzes some principlesand constitutional guarantees that govern the criminal procedure that are not applicable in the Court of the Jury. It is concluded that, due to the non-observance of such principles, the approach given by the mass media to cases of great repercussion can influence the judgment made by the Sentencing Council regarding the formation of a value judgment.
