| Resumo: | Maria da Penha law is considered a female conquer, with the creation of a specific law to protect women it reasures the huge power inequality struggled by them, which increases violence rates and feminicides. For this reason, which aspects of Maria da Penha law must be reformulated in order to avoid the vulnerable situation of domestic violence victims? From the practical point of view, both social and criminal, it's been noticed that the measure is shallow, because instead of predicting individual separation, it should predict the arrestment of the agressor, which is still prohibited by law in art.69, from Lei 9.099/95. |
