A POLUIÇÃO CAUSADA NA GRANDE VITÓRIA/ES PELO PÓ PRETO E A RESPONSABILIDADE DAS MINERADORAS

Abstract

The present work evidenced accounts of pollution caused by mining companies and industries that emit the so-called black powder in the region of Greater Vitória and aims to answer the following question: Which judicial mechanisms can the individual citizen be used to make responsible for the emission of black powder in the Great victory? The article will clarify the measures that can be taken by the public power, to address about Social Rights. It will show the importance of the term of conduct adjustment in the environmental area, as well as dealing with Public Civil Action, protection of the environment and PopularAction, in health protection, laser to public patrimony. Using legislation and bibliographies on the subject it is verified that the companies of the State of Espírito Santo do not obey the constitutional principles and the limits to them established and, for that they are respected, it is essential to consider the importance environmental right, as well as the right of the citizen, which are assured in article 6 of our Federal Constitution.
