A POSSIBILIDADE DE GUARDA DOS ANIMAIS DE ESTIMAÇÃO

Abstract

Pets have assumed an important role within families and in societies. Thus, before a conjugal dissolution or rupture of the stable union, the analysis of the legal situation of the pets began to draw the attention of the Brazilian courts. In this sense, the present work aims to answer the following question: Is it possible to institute custody of the pet, in case of separation of the couple? Therefore, this will be answered based on the current family evolution in the way the domestic animal is treated by society where it is clear that they can not be considered as simple thing in the relationship developed between man and animal in the family environment. Making clear the need for a new creation of legal protection distinct from the one that already exists. This is a deductive research in theoretical and qualitative research using bibliographical and legal documentary material.
