O ABANDONO DIGITAL E A RESPONSABILIZAÇÃO CIVIL DOS GENITORES E RESPONSÁVEIS LEGAIS NA ERA VIRTUAL

Abstract

This paper analyzes children and adolescents' early and unsupervised access to the Internet, focusing on the impacts of parental negligence, or "digital abandonment," on the increase in cybercrimes. Despite legislative advances such as the Internet Civil Rights Framework and the General Data Protection Law, there are still gaps in holding parents accountable for digital omissions. The research uses studies by Patrícia Peck Pinheiro and data from "TIC Kids Online Brasil,", and the results highlight the need for parental monitoring to prevent negligence and ensure civil protection. The study concludes that parents have a legal duty to educate and protect their children in the digital environment, according to the Civil Code and the Child and Adolescent Statute. The research suggests monitoring current laws and public policies to ensure the digital security of minors, with the participation of the State and society.
