| Resumo: | This academic work will address the reality of children and adolescents and the constitutional violations of the adoption institute when the process is lengthy. The increase of children and adolescents in shelters is too high in Brazil, jeopardizing the protection of the right to family life and violating the principle of best interest and full protection of children and adolescents. The exposed study has a bibliographic basis and, initially, it will discuss the history of the adoption institute, the principles that guide it and the adoption models existing in the application. Afterwards, it will criticize the slowness of the system, the form and requirements of the adoption process pointing out the violations of the principle of reasonable duration of the process and regarding the understanding of the norms that have more weight in the adoption institute. Finally, a draft adoption law elaborated by the Brazilian Institute of Family Law will be presented. The bill foresees that adoption agencies should be treated separately in order to guarantee the principle of best interest and full protection, while providing solutions to optimize the adoption process with the purpose of improving the reality of children and adolescents who find themselves living in shelters and on the margins of society. |
| Descrição: | Este trabalho acadêmico abordará a realidade de crianças e adolescentes e as violações constitucionais do instituto da adoção quando o processo é moroso. O aumento de crianças e adolescentes que se encontram depositados em abrigos é demasiado no Brasil, prejudicando a proteção do direito à vida familiar e violando o princípio do melhor interesse e da proteção integral de crianças e adolescentes. O estudo exposto possui uma base bibliográfica e, inicialmente discutirá a história do instituto de adoção, os princípios que a orienta e os modelos de adoção existentes no pedido. Posteriormente, criticará a lentidão do sistema, forma e requisitos do processo de adoção apontando as violações do princípio da razoável duração do processo e quanto ao entendimento das normas que tem mais peso no instituto adotivo. Por fim, será apresentado um anteprojeto de lei de adoção elaborado pelo Instituto Brasileiro de Direito da Família. O anteprojeto prevê que as agências de adoção sejam tratadas separadamente a fim de garantir o princípio do melhor interesse e proteção integral, fornecendo simultaneamente soluções para otimizar o processo adotivo com a finalidade de melhorar a realidade das crianças e adolescentes que se encontram vivendo em abrigos e à margem da sociedade. |
