| Resumo: | This article aims to analyze the prison system from a gender perspective, through understanding the influence of the logic of a patriarchal society in the execution of custodial sentences for women in the country, seeking to emphasize the need for them to be effective. public policies and legal guarantees that enable the recognition that the punitive system must meet the particular demands related to women's conditions, which encompass biological and cultural differences, among others that must be respected, going against fundamental Constitutional principles, such as way of restoring human dignity to these women. The work also aims to analyze how the gender issue influences the way of life of women deprived of freedom in the country, symbols of the antithesis of a model of women built in this society led by men and for men and which, by therefore, it makes the existence of these women as such practically invisible. At another point, this article seeks to conceptualize this logic that governs patriarchal society, correlating it with the influence it exerts on the daily lives of women in general terms, as well as evaluating the reality of the model of penal execution proposed to them. To do so, we will go through the origin of prisons, the realization of the reality that makes them enter the prison system, through the question of their rights while incarcerated to the negligence of their health and hygiene. |
| Descrição: | O presente artigo tem por objetivo uma análise do sistema prisional a partir da perspectiva de gênero, através da compreensão da influencia da lógica de uma sociedade patriarcal na execução das penas privativas de liberdade pelas mulheres no país, buscando-se ressaltar a necessidade de se efetivarem as políticas públicas e garantias legais que possibilitem o reconhecimento de que o sistema punitivo deve atender as demandas particulares e relativas às condições femininas, que abarcam as diferenças biológicas, culturais, entre outras que devem ser respeitadas, indo de encontro aos princípios fundamentais Constitucionais, como forma de restituir a dignidade humana a essas mulheres. O trabalho, ainda, tem o intuito de analisar como a questão de gêneroinfluencia o modo de viver das mulheres em privação de liberdade no país, símbolos da antítese de um modelo de mulher construído nessa sociedade protagonizada por homens e para homens e que, por conseguinte, torna praticamente invisível a existência dessas mulheres enquanto tais. Noutro ponto, o presente artigo busca conceituaressa lógica que rege a sociedade patriarcal, correlacionando-a com a influência que ela exerce no dia a dia das mulheres em termos gerais, assim como avaliar a realidade do modelo de execução penal a elas proposto. Para tanto, passar-se-á pela origem das prisões, a constatação da realidade que as faz adentrar no sistema prisional, pela questão dos seus direitos enquanto encarceradas até a negligência com a sua saúde e higiene. |
