Abstract:
Guarding is a fundamental right of the parents. It should always be attributed taking into consideration the interest of the child. Shared custody aims to ensure the continuity of affective bonds, giving both parents the right and duty to exercise their family power. To answer the research, we ask: How can the institute of Shared Guard, regulated by Law 13.058 / 2014, serve as a tool to combat Parental Alienation? Although to provide a greater conviviality of the child with their parents, due to the equal distribution of time of coexistence, Shared Guard still can not be considered a tool to combat Parental Alienation.
