Abstract:
The present work aims at answering the following question: Limits of State Intervention in Shared Guard are in line with civil principles, especially with the principles of affectivity, resulting from the valorization of the principle of the dignity of the human person. The article, based on bibliographical research and jurisprudence, appreciates, through the inductive method, the institute of shared custody, permissive of the isomeric exercise of the rights and duties of the parents, regardless of the maintenance of the conjugal bond.
